By using any of the Equifax products that you order on this website, you are agreeing to these Terms and Conditions of Use. You should also read our Privacy Policy which explains what we may do with the information provided by you through your use of our website and our Website Terms, which govern your use of this website.

Ownership and rights of use

We or our licensors own all the rights to all the materials contained on this website and all the information the website collects (we refer to all of this as “Materials”). Materials also include all patents, copyrights, trade marks, database rights and any other intellectual property rights that may arise from time to time
You may use only the Materials that you have purchased from us, or that we have agreed to supply to you for your own exclusive use. You may not purchase any Materials on behalf of anyone else, even with their consent. It is a criminal offence to order credit information on behalf of anyone else.

You may:

  • view and display the Materials on a computer screen;
  • save Materials in a digital format to read offline; and
  • make printed copies of the Materials.

Other than as described above, you must not without first getting our written permission:

  • distribute, sell, publish or otherwise make a profit, or use to derive an income from any of our Materials; or
  • use any of our trademarks, patents, copyrights, or any other intellectual rights as may arise from time to time

Your Obligations

By using our services you confirm that all of the information you provide to us is your own information and that the information is accurate, clear and not misleading.
By using our products, you confirm that you agree to receive alerts from us in relation to changes to your credit file information or any unauthorised distribution or use of your information which you may have requested us to monitor.
You agree not to use our products for any other purposes, including, but not limited to the monitoring of third party information.
You agree to keep confidential the password and any other login details you use to access the product or services and not to disclose such passwords and other login details to third parties.
You confirm that by using our service and or products you will not attempt to interfere with the proper working of the service and or products by any means, including but not limited to using any other software, tools, device or other methods, electronic or otherwise.

Important Information About Your Application For Your Credit File

If false or inaccurate information is provided and fraud is identified, details will be passed to fraud prevention agencies. Law enforcement agencies may access and use this information.
We and other organisations may also access and use this information to prevent fraud and money laundering, for example, when:

  • Checking details on applications
  • Managing credit and credit related accounts or facilities
  • Recovering debt
  • Checking details on proposals and claims for all types of insurance
  • Checking details of job applicants and employees

Our liability to you

Any information that we publish about you in this website is collected by us from third parties and is published by us as soon as reasonably practicable after it becomes available. As the Materials we publish about you are provided by a number of sources, we cannot guarantee that the content of the Materials are accurate or complete. As such, we shall not be liable to you under any circumstances, other than those imposed by any applicable law, for any mistakes, errors, omissions or for any other faults that we may publish about you in this website. It is your responsibility to keep your login information and password confidential and secure. We shall not be liable for any loss or damage that you or another person suffers because you did not keep your login information and password confidential and secure. In addition, we reserve the right to disable your login information and password at any time, if in our opinion, you have failed to comply with any provisions of these Terms and Conditions of Use, or any other relevant terms published.

Nothing in these terms affects our liability to you for death or personal injury caused by our negligence, or for any other liability we may owe to you, which we cannot exclude or limit by any applicable law.

We do not accept any liability howsoever arising, by breach of contract and whether caused by tort (including negligence) for any loss of income, revenue, business, profits, contracts, goodwill, anticipated savings, data, productions, or any other indirect or consequential loss or damage, even if foreseeable.

We will use reasonable care and skill when providing the product or service but we do not give any warranty or guarantee as to the accuracy or completeness of any of the information that is provided.

The services and products we provide to you includes

“WebDetect” is our monitoring service which monitors your personal information against unauthorised distribution and use across the World Wide Web. We use carefully selected and trusted partners to help provide this service to you.

Trial Period – If you purchase any of our products on a 30-day free trial basis, you will provide us with your credit or debit card details at the time that you complete the application form. Following the expiry of the 30-day free trial, unless you inform us that you do not wish to receive our Monthly Subscription Product, you will automatically enter into a Monthly Subscription Agreement with us and we will charge your credit or debit card at the relevant rate per month for that product until the monthly subscription is cancelled or otherwise terminated. If you do not wish to enter into a Monthly Subscription Agreement with us, in order to avoid paying any subscription charges, you must cancel the service at least 24 hours prior to the end of the trial period by contacting our Customer Service Department.

Monthly Subscription Products - If you purchase any of our Monthly Subscription Products, we will provide that product to you for a continual 30-day period starting from the date that you sign up to such product or upon the first date after the 30-day free trial ends. We will continue to charge your credit or debit card at the relevant monthly rate for that product unless the service is cancelled by you or otherwise terminated. If you wish to cancel your Monthly Subscription Agreement with us, in order to avoid paying any further subscription charges, you must cancel the service at least 24 hours prior to the end of the relevant 30-day period by contacting our Customer Service Department.

Annual Subscription Products - If you purchase any of our Annual Subscription Products, we will provide the Annual Subscription Product to you for one year from the date that you sign up to such Annual Subscription Product or if you elect to receive one of our Annual Subscription Products after a 30-day free trial ends; upon the first date after such 30-day free trial ends. Following the expiry of the Annual Subscription Product, unless you inform us that you do not wish to continue receiving our Annual Subscription Product, your Annual Subscription Agreement will automatically be renewed with us for another year and we will charge your credit or debit card at the relevant annual rate for that Annual Subscription Product unless the service is cancelled by you or otherwise terminated. If you wish to cancel your Annual Subscription Agreement with us, in order to avoid paying any further subscription charges, you must cancel the service at least 24 hours prior to the end of the relevant annual period by contacting our Customer Service Department.

Promotional codes – If you obtain any of our products using a promotional code, then the following terms will apply:

  • Each promotional code; (i) expires on the date stated; (ii) may only be used for the product specified; (iii) is non-transferable; (iv) has no monetary value;(v) cannot be redeemed for cash or for any refund and; (iv) can only be used by the person to whom it is issued.
  • We will share your login information details with the person who provided you with the promotional code to verify your eligibility.
  • When the promotional code expires, we will charge you for a subscription product unless you cancel before or on the date the promotional code expires.

Price changes

If we need to change the price of your subscription, we will always provide you with at least 30 days' notice by email. Please ensure you keep your email address up to date in the My Accounts section of the Member Centre.

Cancellation and Refunds

As the products that we provide to you are immediately available for your use upon acceptance of your application to receive them, you will not be able to cancel this Agreement under Regulation 10 of the Consumer Protection (Distance Selling) Regulations 2000.

Refunds – Our general policy - Unless you have purchased an Annual Subscription Product from us, we will not refund you for any payments made for any of our products.

Refunds – Annual Subscriptions - If you cancel an Annual Subscription Product for any reason, you may be entitled to a partial refund based on a monthly fee calculation. On or around the date that you cancel the Annual Subscription, we will credit you the Annual Subscription fees that you have paid and retrospectively apply a charge as if you had purchased the relevant service on a Monthly Subscription basis. This charge will start on the date that you started your subscription and continue until the end of the relevant 30 day period in accordance with the terms of the Monthly Subscription above. The new applied Monthly Subscription fee will not be more than the Annual Subscription fee that you have already paid for that year.

For example:
If you start an Annual Subscription Product on 1 January, paying an Annual Subscription fee of £69.99 and cancel your subscription on 15 April, we will charge you an amount equal to 4 whole months at the current monthly subscription rate for the relevant service and re-calculate your fee as follows:
4 months @ the current Monthly Subscription rate (£7.50 per month) = £30.00
Your refund will be £69.99 - £30.00 = £39.99.

Suspension and Termination

We may immediately suspend or terminate your access to any of our products if:

  • any payment that you owe is declined, rejected or reversed for any reason during your subscription period;
  • you breach any of these Terms and Conditions of Use; or
  • we have reasonable grounds for suspecting fraud or improper use.;

You will not be entitled to any refund if we suspend or terminate your service for any of reasons set out under this clause.

Any changes to these Terms and Conditions of Use

We may change these terms at any time by publishing revised or new terms on this website. By using this website and purchasing our products after we change the terms, you accept the revised terms and will be bound by them. We will notify you of the date the changes were last made by showing the date of the changes in the latest version section below, so it is important that you check this page from time to time to take notice of any changes that we may make.
